In the case of private employers, it is generally assumed that there is a close personal relationship with the employee. The law provides that an employment relationship that was essentially established with regard to the person of the employer expires upon the death of the employer (Art. 338a CO). For this reason, the settlement account with the compensation office is closed on the date of death. Accordingly, the date of death is also the end date of the employment contract with the employee.
The rights and obligations are transferred to the employer's heirs or to the employer's representative. All actions in the customer area can only be ordered by the representative or the official heir (officially certified).
The employment relationship may be continued by the representative or the heirs for a limited period of time. In this case, quitt requires a corresponding notification so that we can inform the compensation office. The extraordinary end date must be agreed individually by quitt with the compensation office.
If the employee no longer wishes to maintain the employment relationship, he or she may terminate it by observing the statutory notice period in accordance with the Swiss Code of Obligations.
