General information
According to Art. 329a of the Swiss Code of Obligations, employees are entitled to at least four weeks of paid vacation per year of service. Employees up to the age of 20 are entitled to five weeks' vacation.
In principle, vacation may not be compensated by a monetary payment. The recreational purpose of vacation requires that it be taken in kind. In the case of part-time work with irregular workloads, court practice allows vacation compensation to be paid in addition to wages. This compensation must be specifically listed in the employment contract as well as on each pay slip - quitt implements this in the same way.
quitt calculates the vacation compensation as a supplement to the hourly wage (which corresponds exactly to the legal requirements). It is correct that this supplement to the hourly wage is already included in the total gross wage.
quitt has decided to use this method of presentation for the following reasons:
- Simplification: quitt customers usually calculate with the total of the gross wage. With quitt, the desired total of the gross wage per hour can be entered and quitt calculates the hourly wage and the vacation compensation on this basis. In this way it remains simple and clear for the customer - and there are no crooked numbers in the total of the gross wage per hour.
- If quitt were to add vacation compensation to the gross wage, employers would see their labor costs increase. Experience shows that private employers - especially when hiring hourly employees - are only willing to pay wage costs up to a certain level. If the wage costs are above this level, the gross wage is reduced and/or the incentive for undeclared work is increased.
If you would like to pay your employee's vacation as a supplement to the gross wage, you can increase the gross wage by a fixed CHF amount, e.g. at 25 CHF by 2 CHF to 27 CHF.
How do I enter the vacations days of my employee?
For a monthly wage contract
- If a monthly wage is agreed in the contract, you must note the vacations yourself. Because nothing changes in the amount of wages and vacations are included in the monthly wage.
In case of an hourly wage contract
- Since the vacation compensation is included in an hourly wage contract, no hours need to be recorded in the customer account. Vacation compensation includes a wage premium of 8.33% for four weeks of vacation, 10.64% for five weeks of vacation, and 13.04% for six weeks of vacation.
